This Privacy Policy (or “Policy”) describes how J&J Gaming LLC and our affiliates (collectively, “J&J Gaming,” “we,” “us,” or “our”) collect, use, share, and safeguard personal information when you visit or use any our websites, mobile applications (the “Apps”), games, or services (collectively, the “Sites”). This Policy also tells you about your choices with respect to your personal information and how you can reach us to get answers to your questions. This Policy applies to personal information that we collect on our own behalf and not to personal information we collect on behalf of the businesses for whom we provide products or services (“Establishments”). This Policy also does not apply to anyone acting in their capacity as an employee or independent contractor of ours or of our customers, service providers, or business partners (“Employees”). To the extent we process deidentified information, we will maintain and use the information in deidentified form and will not attempt to reidentify the information unless permitted by applicable law.

Types of Personal Information We Collect.

The following list provides examples of the types of personal information that we collect and process and why we collect and process that personal information:

  • Account Registration. We collect your name, date of birth, address, phone number, and email when you create an account on our Sites or participate in our Loyalty Program. We collect this information to establish your account with us, administer our Loyalty Program, and verify that you are eligible to use our Sites. You can use your account to save your preferences, adjust your settings, receive promotions, and obtain more information about offers from us or our partners.
  • Distance Information. Depending on your settings, when you use one of our Apps we collect your location from the GPS, Wi-Fi, and/or cellular technology in your device to determine your location and your distance from an Establishment. We collect this information to help you find games, promotions, and amusements at nearby Establishments.
  • Site and Email Interactions. We use technology to monitor how you interact with our Sites. This may include which links you click on, or information that you type into our online forms. This may also include information about your device or browser. If you receive emails from us, we also use certain tools to capture data related to when you open our message, click on any links or banners it contains, and make purchases. This information helps us detect and prevent fraud and monitor our communications with you.
  • Mobile Devices. We may collect personal information from your mobile device such as unique identifying information broadcast from your device when visiting our Sites or when you use our Apps. While using our Apps, we also collect information about where your phone is located if location services are enabled for our Apps.
  • Mailing List. When you sign up for one of our mailing lists, we collect your email address or postal address. We collect this information to keep you informed about promotions or offers that may be of interest to you.
  • Tax-Related Information. To fulfill our legal obligations to the IRS, we may collect tax-related information including your Social Security Number, address, and date of birth.
  • Video Surveillance. In some of our locations we use video recording technologies (i.e., closed circuit television security cameras). These cameras capture all activity occurring at the respective premises, and we engage service providers who provide enhanced analysis technologies that use information that may be considered “biometric information” in some jurisdictions (e.g., information about an individual’s facial geometry). We only collect this information to the extent necessary to comply with our legal obligations, detect theft or fraud, and protect our properties. We only retain this information for as long as necessary to meet these purposes. This information is only disclosed to our service providers pursuant to a written contract or with law enforcement or regulatory authorities where necessary to meet our legal obligations or vindicate our legal rights.

In addition to the personal information that we collect from you directly, we may also receive information about you from other sources, including third parties, business partners (e.g., Establishments with whom we have a marketing partnership with), our affiliates, or publicly available sources.

Cookies

When you visit our Sites, we will place browser cookies on your hard drive to collect and store your preferences for viewing our Sites. In addition, our Sites use cookies and other technologies (collectively, “Cookies”) to provide a unique identifier to your computer so that we can generate statistics regarding usage of our Sites, such as the percentage of repeat visitors and other general statistics, and determine the effectiveness of advertisements and sales generated through advertisements. Cookies are also used to assist your log-in to our Sites. Information about your use of our Sites may be collected automatically through Cookies, including, but not limited to:

  • details of your visits to and information generated in the course of your use of the Sites, for example, the timing, frequency, pattern of use, traffic data, location data, the resources that you access, and how you reached our Sites;
  • details regarding the device you use to access our Services, including but not limited to your operating system and browser type; and
  • information about how you interact with our Services or email communications, including whether you open or click links or ads on our Sites.

 

We also participate in behavior-based or targeted advertising, this means that, we and technologies providers use technology (e.g., Cookies) to collect information about your use of our Sites, including so that unless you opt out we can provide advertising about products and services tailored to you. We collect this information pursuant to agreements we have with these third-party technology providers. While we recommend that you leave Cookies turned on, as they allow you to take advantage of some of the features of our Sites, you have the ability to control our Cookies. Specifically, you can configure your browser settings to (i) receive notifications when you are receiving new cookies, (ii) disable cookies, or (iii) delete cookies. Please refer to your Web browser’s help section for information on how to do this. If you choose to remove Cookies or reject Cookies, this could affect certain features or services of our Sites. Unless you opt out, we use Google Analytics, among other Cookies, to collect information about you and how you interact with our Sites. Our use of targeted advertising does not increase the number of ads you see, only how relevant those ads are to you. For information on how you can opt out of our use of Cookies for purposes of targeted advertising, please visit the “Your Choices” section below.

Unless you submit your opt-out selection while logged into your account with us, your request will only be linked to your browser identifier. This means that if you submit your opt-out selection while not logged into your account with us, you will need to remake that selection on each browser or device you use. Your browser may save some information to maintain your privacy preferences. Clearing Cookies or cache may remove previous selections, requiring you to make your selection again. If you submit your selection to us while logged into your account with us, we will attempt to apply your selection across your browsers and/or devices.

Text Messaging

You may have the opportunity to receive SMS or “text” messages, pre-recorded voice messages, or auto-dialed phone calls from us, our affiliates, and related entities as well as third parties. Such messaging may be used to authenticate your identity or mobile device, as well as provide you informational updates about services or products you may have requested.

In providing your mobile device number or cell phone number to us, you knowingly consent to such communications from us or us to use your cell phone number or mobile device number in accordance with the our Terms and Conditions of Use. In providing your number, you represent that you have the authority to agree to receive text messages at the telephone number that you provide to us, or from which you sent the text message request to us. You further acknowledge that no purchase is required to opt in to this service, and you may opt out at any time by following instructions from us and as described in the Terms and Conditions of Use or first text you receive upon initial enrollment. Any such communications you receive from us via SMS or text message will be administered in accordance with your preferences and this Policy.

Use and Processing of Personal Information

In addition to the purposes and uses described above, we use personal information in the following ways:

  • To identify you when you visit our Sites or our business partner’s locations.
  • To provide and improve our services and product offerings.
  • To conduct analytics.
  • To respond to inquiries related to support, rewards, or other requests.
  • To keep you up-to-date with the latest benefits available from us,
  • To send and measure the performance of marketing and promotional materials, including information relating to our products, services, sales, or promotions, or those of our business partners.
  • To provide you with targeted advertising based on your activity on our Sites.
  • For internal administrative purposes, as well as to manage our relationships.
  • To detect and prevent malicious activity, including fraud, and to provide you with a secure experience.

 

Disclosures of Personal Information

We may disclose any of the categories of personal information described above to the following third-parties:

  1. Affiliates and Acquisitions. We may disclose personal information to our corporate affiliates (e.g., parent company, sister companies, subsidiaries, joint ventures, or other companies under common control). If another company acquires, or plans to acquire, our company, business, or our assets, we may also disclose personal information to that company, including at the negotiation stage.
  2. Service Providers. We also disclose personal information to our service providers. Among other things service providers help us to administer and provide our Sites, provide technical support, process payments, and assist in the fulfillment of orders.
  3. Government Entities. We may disclose your personal information to government authorities to fulfill our legal and regulatory obligations under applicable laws. This may include disclosure of information tax information to the IRS or to state gaming authorities as necessary.
  4. Other Disclosures with Your Consent. We may ask if you would like us to disclose your personal information with other unaffiliated third parties (e.g., business partners and Establishments) who are not described elsewhere in this Policy.
  5. Other Disclosures without Your Consent. We may disclose personal information in response to subpoenas, warrants, or court orders, or in connection with any legal process, or to comply with relevant laws and legal obligations. We may also disclose personal information in order to establish or exercise our rights, to defend against a legal claim, to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property, or a violation of our policies, or the provision of services by a third-party intermediary.
  6. Promotional Activities. We may offer contests, sweepstakes, or other promotions solely or in conjunction with third-party partners and/or our third-party partners may offer contests, sweepstakes, or other promotions on our Sites. If you decide to enter a contest, sweepstakes, or promotion that is sponsored, all or in part, by us and/or a third-party partner, the personal information that you provide will be shared with us and with the third-party partner. Their use of your personal information is not governed by this Policy.

 

Your Choices

If you are a resident of Montana or Nebraska, you have the following rights:

  • Confirmation and Access. You may request that we confirm whether or not we are processing personal information about you and request access to such personal information. You may also request a copy of digitally-stored personal information in a portable and, to the extent technically feasible, readily usable format.
  • Correction. You may request that we correct inaccurate personal information that we have about you.
  • Deletion. You may request that we delete the personal information you provided to us or that we obtained about you, subject to certain exceptions.
  • Opt Out of Targeted Advertising. You (or an authorized agent on your behalf) may opt out of the processing of your personal information for online targeted advertising purposes. Such processing may include the use of third-party Cookies as described above. You may opt out of these Cookies by adjusting your browser settings, selecting the “Reject All” option in the cookie banner present when you visit our Sites, entering your choices using the “Customize” option in our cookie banner, or using an opt-out mechanism, such as the Global Privacy Control (“GPC”) on browsers and/or browser extensions that support such a signal.   • Promotional Emails. You may choose to provide us with your email address for the purpose of allowing us to send free newsletters, surveys, offers, and other promotional materials to you, as well as targeted offers from third parties. You can stop receiving promotional emails by following the unsubscribe instructions in e-mails that you receive. If you decide not to receive promotional emails, we may still send you service-related communications.
  • Promotional Mailings. If at any time you do not want to receive offers and/or circulars from us, you can remove yourself from our mailing lists by emailing us (our contact information is below) with “NO SNAIL MAIL” in the subject line along with your name, address and zip code. Please note that our mailings are prepared in advance of their being sent. Although we will remove your name from our mailing list after receiving your request, you may still receive mailings from us that had been initiated prior to your name being removed. You may also opt out of our promotional mailings and marketing by completing the Self-Limiting Form available here.

 

Most of our Sites allow you to access, review, modify, or delete your personal information on your account profile. If our website does not permit you to access, update, or correct certain personal information, or if you do not have an account with us, you may exercise these rights below by sending us an email at info@jjventures.com, or by submitting a request via our online webform located here.

As permitted by law, we may require you to prove your identity when submitting a request. We may verify your identity by phone call or email. Depending on your request, we may ask for information such as your name, the last service you purchased from us, or the date of your last purchase from us.

If you are a resident of Montana or Nebraska, and do not agree with our decision regarding your privacy request, you may submit a request to appeal our decision by emailing us at info@jjventures.com.

How We Protect Personal Information

No method of transmission over the Internet, or method of electronic storage, is fully secure. While we use reasonable efforts to protect your personal information from unauthorized access, use, or disclosure, we cannot guarantee the security of your personal information.

Some of our Sites permit you to create an account. You are responsible for maintaining the confidentiality of your account password, and you are responsible for any access to or use of your account by someone else that has obtained your password, whether or not such access or use has been authorized by you. You should notify us of any unauthorized use of your password or account.

Other Important Information

The following additional information relates to our privacy practices:

Loyalty Program. You may register or redeem a prize for our loyalty program at a kiosk at any of our participating Establishments and/or on our Apps. Once you are registered, each time you visit an Establishment, you will only need to enter your phone number into the kiosk to log-in or check-in on our Apps. The loyalty program will have its own rules regarding rewards points and how they are earned and used, so please read those rules carefully. Occasionally, we may offer sweepstakes within the loyalty program on a Kiosk, through our Apps, or on our social media pages to residents of any state in the U.S. excluding residents of New York, Florida, and Rhode Island. Some of these sweepstakes have additional rules that will outline the sweepstakes rules and operations, so please read those rules carefully.

Third Party Applications/Websites. Occasionally, at our discretion, we may include links to third-party websites or applications that offer third-party products or services on the Sites. These third-party websites have separate and independent privacy policies. We, therefore, have no responsibility or liability for the content and activities of these linked sites, and the presence of any links is not an endorsement of the third party, its websites or applications, or its goods or services. Because this Policy is not enforced on these third-party websites or applications, we encourage you to read any posted privacy policy of the third-party website before using the service or site and providing any information. Nonetheless, we seek to protect the integrity of our Sites and welcome any feedback about these sites or applications to which we might link our Sites.

Changes To This Privacy Policy. We may change our Privacy Policy and practices over time. If we make any changes to this Policy, a revised Policy will be posted on this webpage and the date of the change will be reported in the “Last Updated” block near the top of this Policy.

Visually Impaired. If you are visually impaired, you may access this Policy through your browser’s audio reader.

Minors. We do not knowingly collect the personal information of minors under 18 years of age. If we learn that personal information has been collected on the Website from a minor and without verifiable parental consent, we will take the appropriate steps to delete the information. If you are a parent or guardian and discover that your minor child has an account with us or has otherwise provided personal information, please alert us via the contact information provided below, and request that we delete that child’s personal information from our Sites.
